These Terms & Conditions (the "Terms") govern your access to and use of the Backlink Monitor service (the "Service") provided by Ecom Mediatech ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.

1. Who you are contracting with

You are entering into an agreement with Ecom Mediatech. If you use the Service on behalf of a business, you confirm you have authority to bind that business to these Terms. If you use the Service as an individual you confirm you are of legal age in your jurisdiction.

2. The Service

Backlink Monitor lets you register domains and URLs, and periodically crawls those URLs to determine whether backlinks pointing to your sites remain live, follow, and unchanged. Availability of specific features depends on the plan you have selected.

3. Account and credentials

You must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Acceptable use

You will not:

  • use the Service for anything unlawful, fraudulent, or to send spam;
  • infringe intellectual property or privacy rights of others;
  • interfere with security or availability of the Service, including probing, scanning, scraping at scale, or introducing malware;
  • reverse engineer, resell, or redistribute the Service;
  • circumvent plan limits, rate limits, or other technical controls.

5. Intellectual property

We retain all rights, title, and interest in and to the Service, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan and these Terms.

6. Your content

You grant us a limited licence to host and process the domains, URLs, and other content you submit solely to provide the Service.

7. Payment, subscription, taxes, refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, subscription billing, renewals, tax, cancellations, and refunds are subject to Paddle's Buyer Terms. Refunds are also governed by our Refund Policy.

8. Service level

We work hard to keep the Service reliable but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party outages, and network issues can affect availability.

9. Warranties

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

11. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time from your account settings.

13. Consequences of termination

On termination your right to use the Service ends. You may export your data for 30 days after termination, after which we may delete it.

14. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Ecom Mediatech is established, and the competent courts of that jurisdiction have exclusive jurisdiction over any dispute, unless mandatory consumer-protection laws in your country provide otherwise.

15. Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.

16. Force Majeure

Neither party is liable for failure to perform caused by events beyond its reasonable control.

17. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after changes take effect constitutes acceptance.
